On Friday, Samsung Electronics and Samsung Electronics Rus Company filed an appeal against an additional decision of the Moscow Arbitration Court, which bans the import and sale in Russia of 61 models of smartphones of the South Korean manufacturer.
Recall that initially the conflict unfolded between Samsung and Sqwin SA, which filed a lawsuit demanding to ban the use of the Samsung Pay payment service in Russia, allegedly violating the rights to its invention. In July, a court banned the import and sale of Samsung devices that use Samsung Rau in Russia. On October 19, an additional decision was made, which lists 61 models of Samsung smartphones. On October 21, representatives of the company added that this decision is on appeal, so it did not come into force, but smartphones continue to be sold in stores and through websites.
Managing partner of the Moscow office of Hogan Lovells Natalya Gulyaeva, who represents Samsung, said that by an additional decision, the court overturned its own decision and issued a new decision, although only the Court of Appeal has such powers.
In addition, the court ruled on the basis of an expert analysis of only one smartphone model, but ruled on all the other 60 models.
