Pension News: Divorced daughter will also be entitled to family pension, UP government made a big announcement

New Delhi: The Uttar Pradesh government has taken a big decision for the daughters. Yogi Government 2.0 has announced that family pension will be sanctioned to the divorced daughter of a government servant/pensioner or his wife/husband even when the divorce proceedings have been filed in the competent court while her father/mother is alive. and divorced after his death. But for this the condition will be that such divorced daughter fulfills all other conditions of eligibility for family pension. The Finance Department has also issued an order for this.

It is worth mentioning that till now it was a rule that a government servant/pensioner or his divorced daughter dependent on his wife/husband was entitled to family pension only if she was divorced while the father/mother was alive. Earlier, the Central Administrative Tribunal (CAT) had also made it clear that after divorce, the daughter is entitled to get the family pension of the parents.

Giving a decision in favor of the woman (daughter), CAT has also clarified the guidelines and rules issued by the central government regarding family pension. CAT rejected the arguments of the Central Government and the Northern Railway, which said that the daughter is not entitled to family pension if the divorce is decided after the death of the parents. That is, CAT has also given its decision keeping in mind the interests of the daughters.

The Finance Department has issued a mandate for this. In fact, the Central Government had in July 2017 provided that a divorced daughter dependent on a retired employee/pensioner would be entitled to family pension even if her divorce proceedings were filed in a competent court while her father/mother was alive. And the divorce took place after his death. After this, the state government has decided to implement the central system in such cases.
