This question may be in the minds of many people. That is why, let’s explain the rule related to this. Actually, there is no direct law on what to do or not to do in a car. However, it can be understood by using its discretion as per Section 294 of IPC.
What does section 294 of IPC say?
According to Section 294 of the Indian Penal Code, if any person does any kind of obscene act or dirty work in a public place, If considered obscene by the people present there, it would be considered an offense under Section 294 of the Indian Penal Code. For this, the person ( who is doing obscene acts ) will be entitled to punishment. He will be punished as per the provisions of Section 294 of the Indian Penal Code.
However, this is a bailable stream. That is, the arrested criminal can be released on bail. Section 294 of the Indian Penal Code defines the crime of obscene acts as well as punishment in universal places. Under this, the guilty can be sentenced to simple imprisonment, which can be up to 3 months. There is also a provision for economic punishment in this crime, which the court can determine keeping in view the seriousness of the case and the history of the accused.
Delhi High Court lawyer Anand Katiyar said that ‘if the car is in the public place and there are people nearby, then someone kisses in the car, If people get irritated and consider it obscene, then it can come under the category of crime under section 294 of IPC. But, even after that, many other factors remain, which have to be taken into consideration.’
