Chaturbhuj, an auto driver resident of Mehrauli area of the capital, was accused of causing an accident in Nand Nagri in December 2023. Due to this, not only was his auto confiscated, but he was also arrested. Then when this matter reached the court for maintenance, a CCTV footage saved the auto driver. Advocate Manish Bhadauria told aajtak.in that this is a rare case among claim cases, which has been rejected by the Karkardooma court two days ago.
According to the incident registered with the police, the police had received information about an accident at 9 am on December 7, 2023. The informant had said in the statement that he had left for job in the morning from his home in Seemapuri in an eco car. Then after parking the car in the District Park Nand Nagari bus stand area, I was crossing the road and going towards Mandoli when a fast auto came from Gagan Cinema. The auto driver, while driving carelessly and at very high speed, hit me hard and I fell on the road.
The complainant also wrote an auto number in it. He also said that due to the high speed he could not see the face of the driver. Then in his injured state he made a PCR call from the spot. PCR took the injured victim to GTB Hospital and admitted him there. Whereas, due to delay in treatment at GTB Hospital, the complainant got admitted to a private hospital due to severe pain. The complainant told in the statement that the operation on my right leg was done here. In all this he also suffered a lot of financial loss. Now the police registered this case and started investigation. The police soon seized the auto, sealed it and arrested the auto driver, although he was released on bail.
Driver seen with auto in CCTV
After this, the accused auto driver filed an application in the court on January 20, 2024, saying that he is a resident of Mehrauli area and he never crossed Yamuna by auto. He came to this area for the first time just for police action. For this, CCTV footage there can be shown. Advocate Manish Bhadauria says that the investigation of CCTV footage started from here. On the instructions of the court, camera footage was extracted from CCTV installed in the area where the auto driver had claimed to pass. The same thing happened, in the CCTV footage the driver was clearly seen passing by in the same auto at 9.15 in the morning.
this is how the case opened
The complainant had given the time of the incident as 9 am, the PCR call was also made at the same time. Now the question arose that according to the CCTV footage, if the auto driver was in Mehrauli along with the auto at 9.15 pm, then how could he reach Mehrauli so quickly after causing an accident from East Delhi. It takes about two to two and a half hours to cover the distance between both the places. To confirm this, the police also checked the DVR i.e. call details of the auto driver’s phone. According to which his phone was showing the location of Chhatarpur at 5.45 and Mehrauli at 9.45. All this evidence was presented in the court. Advocate Manish Bhadauria says that when the entire investigation report was presented in the court, the court accepted that the police did not have any evidence to believe that the auto driver was involved in the accident. On the basis of evidence the case was dismissed.
