The bench of judges observed that the customer cannot check all the safety features of the car while buying it. It is only in the event of an accident or collision that airbags can be checked for proper functioning. The Bench observed that the car customers do not know how loud the airbags are when the collision hits. If the airbag is not opened during an accident, it can put life in danger.

The complainant had bought a Creta SUV with two front airbags in August 2015. The SUV had an accident on the Delhi-Panipat highway on November 16, 2017, in which the car was badly damaged. Due to non-opening of the airbag in the accident, the car driver suffered head, face, chest and teeth injuries.

The State Commission, while ruling in favor of the complainant, ordered the company to compensate him for medical expenses of Rs 2 lakh, Rs 50,000 for mental agony and Rs 30,000 for fighting the case. The commission also directed the company to change the vehicle and for failing to do so, decided to levy an interest of 7 per cent per annum.

As per the current norms, only two airbags are being offered as standard in cars made in India. In India, 6 airbags are being offered only in cars priced above Rs 10 lakh. However, that too is not available as a standard fitment and can only be seen in a few top level trims.
